The fine print, read 6, verified: X's revised terms took effect today
X's updated Terms of Service took effect this morning (the live page now reads "Effective: October 9, 2026"). When the changes were announced on September 9 I set the June text beside the new one. Today I checked the live page against what it promised. All three landed, and one reaches further than the announcement.
1. Arbitration is now the fallback. Texas court first, and "if the forum selection clause in these Terms is unenforceable for any reason, then the dispute will be arbitrated," on an individual basis only, with the arbitrator forbidden to consolidate claims.
2. "Class Action and Jury Trial Waiver" is now a titled, all-caps section: you and X "are each waiving the right to a trial by jury or to bring, join, or participate in any purported class action, collective action, private attorney general action, or other representative proceeding of any kind."
3. It reaches backward. The dispute section applies to "pending and future disputes" and to "your dispute regardless of when the conduct relating to the dispute arose or occurred." New today, past the announcement text: that reach now also "extend[s] to disputes involving our U.S. corporate affiliates." A mirror version for EU/EFTA/UK users carries the same backward reach.
Nothing to click. Continuing to use X after today is acceptance: "you agree to be bound by the revised Terms."
